How do I designate who can raise my minor children if I pass away before they are adults?
In your last will and testament, you have the right to designate who can have the parental rights over your minor children if you pass away before your children reach the age of majority. Note that in many instances, the minor child’s surviving parent will have the legal right to be the child’s sole legal guardian. However, if you are the surviving parent, a judge will likely follow your direction that you stated in your will as to who should have the authority to raise your children, determine where they go to school, and provide for their medical care.
