If you have an existing estate plan that was not created through MyAdvocate and you are going through a divorce:
- Review all existing estate planning documents
- Revoke existing spousal designations in Power of Attorney or Health decision documents.
- Create new a new Last Will and Testament or Living Trust with Pour Over Will documents for yourself, if appropriate, by creating an account with MyAdvocate and answering “No” to the “Do you have a spouse or life partner?” question and then complete the remainder of the estate planning creation process. Once a new Will is signed, your old Will is automatically revoked.
If you are going through a divorce and have an existing estate plan that was created through MyAdvocate where you are the person who established the account and you have the login credentials:
- Review all existing estate planning documents
- Revoke existing spousal designations in Power of Attorney or Health decision documents.
- Update your estate plan and answer “No” to the “Do you have a spouse or life partner?” question and then complete the remainder of the estate planning creation process. Once a new Will is signed, your old Will is automatically revoked.
If you are going through a divorce and have an existing estate plan that was created through MyAdvocate where you are not the spouse who established the account and you do not have the login credentials:
- Review all existing estate planning documents
- Revoke existing spousal designations in Power of Attorney or Health decision documents.
- Create new new account and then create a new Last Will and Testament or Living Trust with Pour Over Will documents for yourself, if appropriate, by creating an account with MyAdvocate and answering “No” to the “Do you have a spouse or life partner?” question and then complete the remainder of the estate planning creation process. Once a new Will is signed, your old Will is automatically revoked.
