A trust in which all trust terms are included in a Will. When you create a testamentary trust, there is no separate trust document other than your Will. Testamentary trusts are often used when a beneficiary is a minor or when the person writing the Will wants to put certain restrictions on an inheritance.
For example, a person who makes a Will for minor beneficiaries will provide that the inheritance of minor beneficiaries be placed in a testamentary trust until the minor reaches a certain age.
